Justice Court
The Toole County Justice Court serves both Toole County and the cities of Shelby and Sunburst, ensuring fair and accessible justice for all residents. In November 2023, Donna Whitt was elected as Justice of the Peace for Toole County and City Judge for Shelby and Sunburst. The office is located in Room 104 on the lower level of the Toole County Courthouse and is open Monday through Friday from 8:00 a.m. to 5:00 p.m. Autumn Combs and Brenda Alexander serve as Clerks of Court and assist with daily court operations.
The Justice Court handles a variety of cases, including all traffic citations issued within the city and county, as well as tickets from the Montana Highway Patrol, Gross Vehicle Weight violations, Fish, Wildlife & Parks citations, and offenses involving minors related to driving, alcohol, or tobacco. The court also manages small claims, civil matters under $15,000, and Animal Control cases. In addition, the Justice Court performs marriage ceremonies and provides other judicial services to the public.
The Justice of the Peace is an elected official serving a four-year term and is responsible for conducting hearings, issuing warrants, and ensuring that legal proceedings are carried out in accordance with Montana law.
